General Exceptions under Indian Penal Code for CLATChapter IV i.e. Section 76 to 106, of Indian Penal Code lays down various General exceptions that an accused may use as a​​ defence. To solve legal reasoning questions related to General Exceptions, you must check all the ingredients of an exception to hold an accused not liable of the said offence. We will be explaining​​ a few​​ defences​​ individually below.Mistake of FactSection 76 and section 79 deals with the Mistake of fact. The maxim ‘ignorantia juris non excusat’ means that ignorance of law is not an excuse. A person can be excluded of a criminal liability if his act is due to some mistake but such mistake must pertain to the fact and not to the law. Such belief in the mistaken fact must be in good faith.Illustration: Riya and Priya own same watches but Priya had no idea about it. Priya​​ went to Riya’s room and saw the watch on the Table.​​ Assuming that it is her own watch,​​ she took it. She can get the defence of Mistake of Fact.​​ Judicial ActThe Judges are protected by this special immunity under this exception. A judge cannot be made liable for an act that he does in his capacity as a judge in the exercise of any power that he believes is given to him by law. Such belief and exercise of such power must be in good faith. The section dealing with it is section 77 of the Indian Penal Code.Illustration: If a judge takes bribery from one of the parties and pronounces the judgement in their favour, the judge will be liable irrespective of this immunity as he has not acted in good faith.Necessity/ Self PreservationSection 81 of the Indian Penal Code deals with the Doctrine of Necessity. It means that a person will not be liable to commit an offence if he does any act even with the knowledge that is likely to cause harm if it is to prevent another harm to person or property. The main point that must be checked if the defence of necessity can be given or not, is that even if knowledge of causing harm is there but the act must be done in good faith and without any criminal intention.​​ As per the explanation of this section, the harm being prevented must be an imminent danger.Illustration: A man and a child are stuck in house which is on fire and there is no escape. The man in order to save the life of the child threw him from the roof towards the people who were standing with the blanket to catch the child. But the child falls and dies. The man will not be liable and will get the defence of necessity. InfancyAs per section 82 of the Indian Penal Code, a blanket protection must be given to the children below 7 years of age. It means that​​ a child below 7 years of age cannot be made criminally liable for any offence committed.The section 83 of the Indian Penal Code states that any child under the age of 12 years is also not criminally liable for any offence committed but there is a condition attached to it. The condition attached is that such child must be immature as to the consequences of the Act.​​ Both these sections operate on the maxim of Doli Incapax.Illustration: Siddharth is a child aged about 6 years and he stabbed his mother with the knife while she was sleeping. He will not be criminally​​ liable for​​ murder as he is less than 7 years of age.InsanityThe exception of​​ insanity​​ is dealt with Section 84 of the Code. The person is not criminally liable for an offence committed by him if he had an unsound mind and consequently he was incapable of understanding the nature and the consequence of the act. ​​ It must be proved in the court that the person was unable to judge whether his act was right or wrong​​ and also he did not understand that his act was contrary to law.Illustration: Akash is suffering from Autism since childhood. He went to a shop with his mother and stole a packet of biscuit from the counter.
